Looking to the facts of the case and the direction issued by the Supreme Court in the case of Arnesh Kumar Vs. State of Bihar and another (2014)8 Supreme Court Cases, 273, in my opinion, prima facie the applicant is eligible to get the benefit of Section 438 of the Cr.P.C. Consequently the application is allowed. It is ordered that in the event of arrest of the applicant in connection with the aforesaid crime number and the offences, applicant be released on bail on his furnishing a personal bond in the sum of Rs. 50,000/- (Rupees Fifty Thousand only) with one solvent surety of the like amount to the satisfaction of the Investigating Officer/ Arresting Authority. The applicant is directed to join the investigation immediately and to cooperate with the investigating agency.
