Sardari Lal Gupta vs Siri Krishan Aggarwal on 1 May, 1984
The argument raised by learned counsel for the
petitioner on the strength of Sardari Lal Gupta vs. Siri Krishan
Aggarwal 1984 AIR (Punjab) 439 and Smt.Shakuntla Rani vs.
Shri Ram Kanwar 1993 CivCC 486 do not advance the case of
the petitioner inasmuch as that Sardari Lal Gupta's case
(supra) is a decision rendered by the High Court in regular
second appeal, where after conclusion of the evidence of the
parties, it was found that the wall in between the properties was
a common wall to which both the parties had right to raise
construction.
