The said order of the first respondent is challenged by the petitioner on various grounds, viz., that the first respondent has not taken into consideration the reason assigned by the petitioner for not signing the cheques along with the third respondents; that the petitioner has made a representation on 24.12.2007 to cancel the resolution dated 12.1.2007 and till date the first respondent has not passed any orders on the representation; that under Section 188(3) of the Act and as per the guidelines issued by the Government, the first respondent while passing order has to apply his mind and give reasons and therefore, by relying upon the judgment of the Division Bench of this Court in Pugazhendran v. B.G.Balu, 2005 (1) CTC 545, the petitioner challenges the said impugned order on the ground that the same is in violation of the procedure contemplated under the Act.
