During the hearing, learned senior counsel for the petitioner confines his prayer only to the release of the passport of the petitioner. Learned senior counsel for the petitioner has argued that the impounding of the passport is illegal and contrary to law laid down by the Apex Court in 'Suresh Nanda Vs. CBI' 2008 (1) RCR (Criminal) 897. Learned counsel for the respondent on the other hand has argued that the father of the deceased has approached the Apex Court for adding the offence under Section 304 IPC in the present case. Therefore, the respondent fears that if the passport is released, the petitioner will leave the country.
