4.5 It is submitted that non-holding of election as
per the Rules governing the administration of the Trust
is an example of mismanagement, for which Section 41A
application would be maintainable. Reliance is placed on
the decision of this Court in the case of Pavankumar Jain
Vs. Priyavadan Ambalal Patel, reported in 2016(1) GLR,
242, where it is held that the powers under Section 41A
cannot be restricted to the matters falling under
Sections 32 to 41 of the Act only.
