We fail to see how this paragraph will be of any help in supporting the arguments of the learned counsel for the petitioner, since the contentions put forward by the appellant in Rajendra Roy's case (Supra) were considered by the Supreme Court and answered in paragraph 7 of the same judgment, which lays down the ratio of the case.
