Furthermore, in
view of filing of DAR containing the charge-sheet for the
offences u/s 279/337/338 IPC & u/s 185 of M.V. Act & other
relevant documents against the respondent no. 1 and in terms of
the judgment in the case of "National Insurance Co. Vs.
Pushpa Rana & Ors.", 2009 ACJ 287, Delhi, respondent no. 1
(driver of the offending vehicle) is held to be negligent on the
basis of preponderance of probability. From the DAR, it is also
stands established that respondent no.2-Manoj Kumar was the
registered owner of the offending vehicle, which was insured
with respondent no.3-ICICI Lombard General Insurance
Company Ltd. vide Policy No. 3001/MI-11308665/00/000,
valid from 31.08.2022 to 30.08.2023.
