In Pathu v. State of Kerala 1975 Ker LT 696,
Janaki Amma J. had occasion to observe that under the
circumstances of that case an order under Section 451
was a final order between the parties as it finally
disposed of the rights of one of the parties who was a
stranger to the litigation. There are other decisions
also which took the same view.
