Court held that a rule which merely affects
chances of promotion cannot be regarded as
varying a condition of service. Chances of
promotion are not conditions of service.

seniority, tenure or termination of service etc.

reduction in the chances of promotion does not
tantamount to a change in the conditions of service.
A right to be considered for promotion is a term of
service, but mere chances of promotion are not.
Reference in this regard can conveniently be made
to a recent judgment of the Honble Supreme Court in
Dhole Govind Sahebrao and Others Vs. Union of
India (2015) 6 SCC 727 wherein it was held as
under:

In State of Madhya Pradesh and
Others Vs. Shardul Singh, (1970) 1 SCC 108,
this Court held that the term conditions of
service means all those conditions which
regulate the holding of a post by a person
r right from the time of his appointment
(emphasis supplied) to his retirement and
even beyond, in matters like pensions etc.
