Accordingly, the present criminal misc. application succeeds and is allowed. The impugned summoning order dated 12.2.2018 passed by Additional Chief Judicial Magistrate, Court No. 3, Meerut in Complaint Case No. 8066 of 2017 (Girdhari Giri Vs. Minakshi and others), under Sections 147, 323, 504, 506 IPC, P.S. Mundali, District Meerut as well as order dated 12.9.2022 passed by Additional Sessions Judge, Court No. 2, Meerut in Criminal Revision No. 341 of 2021 (Smt. Minakshi Vs. State of U.P. and another) is set aside. The Additional Chief Judicial Magistrate, Court No. 3, Meerut shall pass a fresh order in the light of the observations made herein above.
