are his but the summons were not served upon him in his presence.
Accordingly, the Courts have refused to interfere in the application for
setting aside the ex parte proceedings by recording a finding that the
petitioner was well aware and had the knowledge of the ejectment petition.
The judgment which has been relied upon by the petitioner in Sukhbir
Singh's case (supra) is not applicable in the facts and circumstances of the
present case since this Court noticed that the landlord had not come forward
in support of the statement of the process server.
