4.Per contra, the learned counsel appearing for the 2nd
respondent, relying on the decision of this Court in Shibu
George V. State of Kerala 2016 KHC 2940 contends that
the absence of particulars in the affidavit is no reason to
reject the prayer of the respondents and it is always open
for the learned Magistrate to afford an opportunity to file a
fresh affidavit containing all details as mandated in the
said provision.
