"यदि किरायेदार द्वारा निर्मुक्ति प्रार्थना पत्र प्रस्तुत होने के उपरांत वैक्लपिक व्यस्था ढूंढे जाने हेतु कोई प्रयास नहीं किया गया तो तुलनात्मक कठिनाई प्रार्थी के पक्ष में होगी, परन्तु जैसा की उप्पेर अवधारित किया जा चूका है की प्रति की विवादित दुकान निर्मुक्त किये जाने के संबध में आवस्यकता संभावना पूर्ण नहीं है, अतः तुलनात्मक कठिनाई उसके पक्ष में निर्धारित होने का कोई प्रश्न उत्पन नहीं होता", the same is totally incorrect and wrong finding as it is well settled proposition of law that if a tenant does not make any effort to search alternate accommodation then his need cannot be considered [See: Mst.
