There is no credible evidence to show that the applicant was the person instrumental in getting the money withdrawn from the said SB accounts. Even there is no credible evidence to show that the money was transferred in the said account by the applicant. It is further argued that the co-accused Zahiruddin Khan has been granted bail by this Court vide order dated 28.7.2022 passed in Criminal Misc. Bail Application No. 35973 of 2021 (Zahiruddin Khan vs. State of U.P.), copy of the said order has been placed before the Court which is taken on record.
