Lakshmi Ammal (Died) And Ors. vs J. Victor And Ors. on 18 October, 1997

In Lakshmi Ammal (died) and 6 others v. J. Victor, 1998(3) L.W. 189 P. Sathasivam, J. had occasion to consider an identical situation and held that the vendor who has agreed to sell the property to the purchaser, the plaintiff in the suit, in the absence of any denial in the written statement by the said executant, it is sufficient if the executant who had agreed to sell the property for a price has signed it for being enforced by way of filing a suit for specific performance. The Learned Judge has granted a decree in respect of the agreement to sell signed by the vendor alone and held that it is not necessary that it should be signed by both the parties to the agreement. Mr.K.Sreenivasan is well found in relying upon this decision of P.Sathasivam, J."
