Mr. Kunal Vyas learned counsel appearing for  Mr.   Amar   Bhatt   for   the   respondent­Company  supported   the   impugned   judgment   and   order   of  learned   single   Judge   and   submitted   that   the  principle rendered in Raipur (Rakhial) Commercial   Co­op.   Housing   Society   Ltd.   and   another   v.   Ahmedabad Electricity Company Ltd's case (supra),   by   relying   upon   which   the   learned   single   Judge  passed   the   impugned   judgment,   was   challenged   in  LPA No.685/2006, which was rejected vide judgment  and  order  dated  01.05.2006.

5.1 In   support   thereof,   Mr.   Shelat   placed  reliance  upon  the decision  of Bombay   High Court  in  M/s.   Bharat   Barrel   &   Drum   Manufacturing   Co.   Ltd.,   v.   The   Municipal   Corporation   of   Greater   Bombay and another, AIR 1978 Bombay 369  wherein,  it has been held that the provision in Section 24  of   The   Electricity   Act   has   to   be   properly  appreciated   in   the   context   of   the   obligations  cast  and  the restriction   placed  on the  licensee  u/s.22, 22A, 22B, 23 and 24 itself. In the light  Page 4 of 7 C/LPA/1518/2006 JUDGMENT of   these   statutory   provisions,   there   is   no  warrant   to   read   the   word   "due"   in   the   narrower  sense  viz.  as only  restricted  to  amounts  within  the   period   of   limitation   or   which   could   be  successfully   claimed   by   a   suit.   In   other   words  there   is   no   logical   basis   shown   for   preferring  the   narrower   construction   to   the   ordinary  construction   i.e.   the   wider   construction.   The  wider   meaning   would   be   more   in   accord   with   the  scheme   of   statutory   provisions   as   also   with  commercial honesty.

The  decision   in the  aforesaid LPA was reported in 2006(3) GLR 1944 in   Torrent   Power   AEC   Ltd.   v.   Shreeji   (Rakhial)   Commercial   Co­operative   Housing   Society   Ltd.  Similar principle was rendered by the Full Bench  of   this   Court   in  Sanjay   Balvantrai   Desai   and   others v. Dakshin Gujarat Vij Company Limited and   Page 5 of 7 C/LPA/1518/2006 JUDGMENT others,   2013(1)   GLH   363.   It   was,   therefore,  submitted   that   the   respondent­Company   cannot   be  fastened with the liability to pay amount of the  defaulter   from   whom   the   property   has   been  purchased   as   a   condition   precedent   for   getting  new connection.
