It is also seen by this court that the Rajasthan Panchayati Raj Rules, 1996 have also been amended vide Notification dated 11.5.2011 which mandates requirement of qualification as provided by NCTE pursuant to section 23 (1) of the Act of 2009. The Notification of the NCTE so as the Rules of 1996 are not under challenge before me thus this court cannot give direction contrary to statutory provisions so as to make them redundant. The issue of required qualification at the level of elementary education was declared by the Hon'ble Apex Court in the case of Yogesh Kumar (supra) holding that B.Ed. holders are not eligible for appointment.
