The contention of the learned counsel appearing for the appellant is that the Will dated 1.2.1872 said to have been executed by A.K.Venkatacharyulu, was not probated and as such it cannot be relied on for the purpose of title or execution as per Section 119 of the Hindu Wills Act, 1870 which is pari materia with Section 213 of the Indian Succession Act, 1925. To substantiate his contention the learned counsel for the appellants relied on a decision in Madhukar Ranjanna Darbhe vs. Union of India reported in (2008) 2 Bom. CR 418.
