47. Bhupendra Nath Prasad (supra) has considered a case where, the post mortem doctor was not examined. The post mortem report did not establish the cause of death. The doctor who had examined the deceased had stated that the family members who brought the deceased to the hospital told him that somebody made the deceased take wine and betel and thereafter, the deceased had started vomiting. The evidence regarding the dying declaration had been found to be untrustworthy and does not inspire confidence. Therefore, the Court had found reasonable doubt about the cause of death.
