Punjab State Civil Supplies Corp. Ltd vs Sikander Singh on 24 February, 2006
29. The learned counsel for the defendant has relied
on a decision reported in AIR 2006 Supreme Court 1438,
in the case of Punjab State Civil Supplies Corp. Ltd., v.
Sikander Singh, wherein in para 34 of the judgment, their
lordships have observed that
"Negligence in the performance of a duty under
a contract of employment may give rise to a
disciplinary proceeding but as at present
advised, in a case of this nature, we are of the
opinion that same would not give rise to a
cause of action for recovery of money for the
goods lost as in the disciplinary proceeding
itself recovery of money from the delinquent
can be directed by way of punishment".
