38. This court is not placing reliance upon the judgments filed by Ld.
Counsel for defendant no.2 on concealment of material facts and alleged
fraud upon the court. Similarly the judgment relied upon by plaintiff, i.e.
Hardev Singh (Supra) holding about the ostensible owner, is not relied
upon by this court for the reason that the Gift Deed is not under challenge
by way of specific remedy and therefore, it can not be decided by this court
rather it is not within purview in simple suit for injunction to decide the
question of title.

37. Consequent to the above discussion, this issue is decided in favour of
defendants and therefore present suit is dismissed as being not
maintainable. The plaintiff is relegated to proceed for specific remedy in
light of judgment of Anathula Sudhakar (Supra).
