The main contention of Sri Tiwari, learned counsel for the petitioner, is that since the trial court had called for a report from the Amin-Commissioner and there was no objection filed to the said report by either of the parties, the trial court ought to have relied on the valuation given in the said report, instead of assessing the valuation of the suit on the basis of the rental value of the property. The trial court as well as the revisional court have accepted valuation of the suit determined on the basis of the annual rental value of the suit property, which principle has also been accepted by this Court in the case of Mitthoo Lal v. Gopal Chand, AIR 1979 All 226.
