The Tribunal rejected the petitioner's OA on the ground that, once
criminal proceedings stood instituted against the petitioner under
Section 498A of the IPC, the principles enunciated in the decision of
the Supreme Court in Union of India v. K.V. Jankiraman6 would
apply and that the petitioner's case for promotion to the post of SSA
would have to be placed in a sealed cover.
