18- In Muneshwara Nand's case (supra), the allegation against the complainant was that he does not do any work; that he was always found to be with his wife (Begum Sahiba) and that he has to be called from inside his house; during the period of his posting none has been happy except one Inspector and that the medicines were taken out of stock and sold in Delhi. It was found that the sanction as contemplated Section 197 of the Code is different than the sanction sought under Section 198-B of the Code of Criminal Procedure, 1898.
