5. It is submitted that a bare reading of the
impugned order/government resolution would show
that respondent No.1 has invoked power under section
92 and/or section 312(A) of the Maharashtra Municipal
Councils, Nagar Panchayats and Industrial Townships
Act, 1965 (for short 'Act of 1965'). By placing reliance
on judgment of the Hon'ble Supreme Court in the case
of G.B.Mahajan and others v. Jalgaon Municipal Council
and others, reported in (1991) 3 SCC 91, it is
contended that section 92 would not apply to the
present case, as the Hon'ble Supreme Court in the
aforesaid judgment in similar circumstances held that
such an agreement for development of market on BOT
basis would not be covered under section 92 of the Act
of 1965.
