In the above case, even if there is a case made out, the Supreme Court was of the view that it should be a deliberate and conscious act of perjury. The Supreme Court has also held that in view of the long lapse of time of more than 10 years was not a factor which is not wholly irrelevant for considering the question of expedience of initiating prosecution for the alleged perjury. It may be noted here that in this case, there is a delay of more than 12 years.
