11. In the order impugned herein, the challenge is to the
delivery of properties. Admittedly, no rent has been paid all these years and
assessment has also not been made even after issuance of patta under
Section 13 of Tamil Nadu Minor Inams Estates (Abolition and Conversion
into Ryotwari) Act, 1963. Though patta has been issued under Section 13 of
the Act in respect of the superstructure, still the entire land on which the
building is situate will be covered by Section 13(1), as held by the Apex
Court in the case of R.Manicka Naicker vs. E.Elumalai Naicker (supra).
