My attention was drawn by the learned Counsel to one more judgment of this Court, this time having been delivered by a Division Bench in the case of Bhaguirati Narayan Borkar & another v. Ema Lima Cota Furtado & others, , which has upheld the view taken by the Single Bench and held with regard to the deeming provision in Explanation I to section 2(p) of the 1975 Act and the availability of protection from eviction on that count that mere institution of a suit was all that was necessary for taking the claim of the defendant of being mundkar out of purview of the section.
