Ram Bharosey Lal Krishan Kumar vs State Of U.P. & Ors on 21 October, 1971

In case of Ram Bharose Lal Vs. State of U.P. (supra), the review petition against an order passed by the writ court was dismissed by the Division Bench of this Court. The Division Bench held that the main relief sought by the petitioner is to direct the District Magistrate to effect change or mutation in the relevant revenue records of rights by expunging the name of the vendors and entering the name of the vendees, actually seeking direction to the Collector to make mutation of the name of the petitioner similar to an application under Section 34 of the U.P. Land Revenue Act, 1901. Even though, the relief sought by the petitioner may be under different Act, but the legal effect of the order of mutation in that event also remains same. The Division Bench dismissed the review petition.
