submit that the issue that arises for consideration in this writ petition is whether
Rule 45 and 50 of the Trade Marks Rules is directory or mandatory, and that the
same issue came up for consideration before various High Courts and finally

Registrar Trade Marks, Trade Marks Registry, New Delhi and another
reported in (2022/DHC/004701), wherein the Delhi High Court following the
decisions of various High Courts held that there 2nd respondent does not have the
discretion to condone the delay beyond a period of one month. Accordingly,
learned counsel for respondents prayed for appropriate orders.
