We, therefore, hold the same. So far as appellant Pappan @ Kishore is concerned, in a sudden quarrel in heat of passion without premeditation and without taking undue advantage he caused only one injury by knife, therefore, his act would fall within the purview of Exception 4 of Section 300, IPC culpable homicide not amounting to murder punishable under Section 304(1) of IPC.
