25. Sh. M.L. Sharma, learned counsel for the petitioner referred to the decision reported in AIR 1981 HP 68 (Surinder Nath v. P. N. Dhawan). A perusal of the judgment indicates that the learned Chief Justice in that case was dealing with an entirely different ground of eviction which is not in issue in the present case. Moreover, the propositions as settled by the apex Court in the aforesaid decisions were not examined in this case.
