They can be treated as tenants holding over or tenants by sufferance. Such type of possession is not only permissible, but is protected in law. Hence, it becomes and continues to be lawful. A Division Bench of this Court in M. Annapurnaiah v. M. Narasimha Rao, , held that the possession by a tenant by sufferance is juridical so much so that he is entitled to be granted an injunction even against a landlord from interfering with his possession.
