the Hon'ble Apex Court was pleased to consider the judgment in
Mahajan's case (supra) on the point of the amount of compensation
which can accrue to the claimants by reason of death which also
(emphasis supplied) must be taken into consideration to balance the
losses and gains by reason of death.

Another reported in 2009 (6) SCC 121 underscoring the award of a
"just compensation" in favour of the claimants.
