20. It is no doubt true that both the cases were decided by the Supreme Court prior to the Forty-Second Amendment of the Constitution, an opportunity of hearing which was required to be afforded to the delinquent in respect of one of the three punishments mentioned in Article 311(1) of the Constitution has been dispensed with. The question, however, is whether the Forty-Second Amendment of the Constitution has brought about any change in the position in the matter of supply of a copy of the report of the Enquiry Officer to the delinquent. The Supreme Court was called upon to decide this question once again in the case of Union of India v. Mohd. Ramzan Khan .
