I afraid to accept the
contention to be correct because the aforesaid judgment
does not lay down a law but only interprets the meaning
of Talak prevalent in muslim community and, therefore,
whether the Talak took place before the judgment in
Shamim Ara's case (supra) or after, for its validity,
both the conditions, as enumerated, are required to be
fulfilled.
