23. Having held that a writ of habeas corpus is maintainable by
a person who is under detention if his rights are violated, the
question that remains to be answered is whether in the present
case any right of the detenus was violated which could have led
to the issuance of an order directing his release from prison. We
may make reference to the judgment of this Court in the Col. Dr.
B. Ramachandra Rao v. The State of Orissa, wherein it was
urged before this Court that the orders of the Court directing the
detention of the petitioner were illegal. In this case, the Court
has held as follows:

In Saurabh Kumar v. Jailor, Koneila Jail, this Court came to
the conclusion that the petitioner was in judicial custody by
virtue of an order passed by the judicial magistrate and, hence,
