Umashankar vs State Of Chhattisgarh on 5 October, 2001
In the Judgment titled as Umashankar v. State of Chhattisgarh,
the Apex Court has held that mens rea is essential ingredient to
constitute the offence under Sections 489B & 489C of the
Indian Penal Code and the prosecution is required to prove
mens rea that the appellant was in possession of counterfeit
currency note knowing or having reason to believe the same to
be forged or counterfeit and in absence of such prove, any
conviction under Sections 489B & 489C of the Indian Penal
Code is not sustainable under the law.
