Thus, even assuming as correct, your contention that you are
eligible for Gratuity under Payment of Gratuity Act, 1972, then you
would not be eligible for Pension under the Railway Services
(Pension) Rules 1993, as it has been laid down under Rule 3 (19) of
the RS (Pension) Rules 1993 that pension includes Gratuity. The
same view has been taken by the Hon'ble Gujarat High Court in the
case of Rajkot Municipal Corporation vs. Aniruddh Fulshankar
Shukla decided on 19.04.1999.
