5.It was contended on behalf of the Board that since the TN
HR&CE Act, 1959 is a self-contained code, the petitioner will have to be
relegated to avail the alternate remedy. We are however not persuaded by
the said submission. When the challenge is made on the jurisdictional
foundation, the petitioner need not be relegated to avail the alternative
remedy. It is well settled principle of law that availability of alternative
remedy is not an absolute bar for granting relief in exercise of power
