5. Since the said offences alleged against the petitioners are
punishable with less than seven years of imprisonment, this Court
is of the considered view that the petitioners are entitled to be
issued notice under Section 41-A Cr.P.C. Therefore, the petitioners
shall appear before the Investigating Officer concerned on or
before 25.10.2023 and in turn, the Investigating Officer shall issue
notice under Section 41-A Cr.P.C and shall follow the guidelines
formulated by the Hon'ble Supreme Court in Arnesh Kumar v.
State of Bihar 1scrupulously. However, the petitioners shall co-
operate with the Investigating Officer as and when required by
furnishing information and documents as sought by him in
concluding the investigation. Further, the petitioners are permitted

to make their oral submissions and also to furnish the documents
relied upon by them at the time of investigation and the same shall
be considered by the investigating officer before filing any report.
