In a large number of cases, this Court as also various High Courts have
emphasized the need of conducting a search in presence of independent
persons. The law-requires that such search should normally be conducted by
a magistrate or a gazetted officer. Even presence of a gazetted officer in
the raiding team would not subserve the requirements of Section 50 of the
Act.
