injured was fit for statement as per the MLC. As per testimony of
PW-12, after obtaining the MLC of injured Ganesh from the GTB
Hospital, IO had made request to the injured to give his statement but
he denied and said that he will come in the police station and then make
his statement to the IO. He has not deposed that the injured was not in a
position to give statement due to pain or injured had made any
complaint of any pain in his body. In these circumstances, the delay of
nine hours in giving the statement is fatal to the case of the prosecution.
Hence, the judgment Laddan Vs. (State Govt of NCT) of Delhi (supra)
relied upon by Ld. Chief PP is not applicable to the facts of the instant
case.
