(A) Ld. Trail Court failed to consider that it had no territorial
jurisdiction to decide the case of the plaintiff. That the defendant
No. 3 was residing at Ludhiana, Punjab and was having an
account at Ludhiana. Even the cheque in question was allegedly
sent from Ludhiana. The defendant No. 1 was having his account
in the branch of the defendant No. 2 at Murthal, Haryana. The
cheque was presented by the defendant No. 1 at Murthal,
Haryana branch only. As such, no part of cause of action had
arisen in the jurisdiction of the Ld. Trial Court.
(B) That the original cheque in question was never brought on record
by the plaintiff either by itself or through any other witness by
summoning the same and as such, any alteration, if any, on the
said cheque can not be verified from the copy of the cheque
(Ex.PW1/B) on record.
