The same view was reiterated by this ,Court in State of Maharashtra v. Mayer Hans George (2) . But in both those cases this Court recognized that the language of a provision either plainly or by necessary implication can rule out the application of that presumption. Further the Court may decline to draw that presumption taking into consideration the purpose intended to be served by that provision.
