8. After taking into consideration the submissions advanced by
the learned counsels and Inquiry referred above and the judgment
given by Hon'ble Apex Court, I am of the view that in this case also
similar principle will apply as petitioner remained absent for a long
period without any leave. Therefore, at this stage he cannot claim

for departmental proceeding and any other formalities. We must
remember that when a person approaches the Court of Equity he
must come with clean hands. If the principle of 'equal pay for
equal work' applies then in contrary 'if there is no work there
should be no pay' and the facts remain also from the Inquiry
Report that petitioner has served the school in question till 2004
but he received salary till 2010. He has received an excess amount
without doing any work. Therefore, he is directed to repay back the
excess amount to the Government within three months.
