The views of the constitution bench
judgment in Mohinder Singh Gill's case has been re-affirmed by the

Supreme Court in Gordhandas Bhanji's case (supra). In such view
of the matter, by applying the aforesaid test to the facts of the
present case, this Court is also of the considered view that the
conduct of the Opposite Parties in rejecting the candidature of the
petitioner in both the writ applications is unjust, unfair and
arbitrary. As such the same is liable to be quashed.
