4. The RTE Act of 2009 came into force in 2010
and the State Rules under the Act where brought into
force in 2011. Ext P1 G.O dated 7.10.2011 was brought
out for the purpose of stipulating norms in considering
the application for NOC and recognition, as spoken of in
W.A.No.949 of 2019 6
the CBSE affiliation by-laws. The Management
Associations challenged Ext P1 in so far as the terms
prescribed for granting NOC. The challenge was allowed
and certain clauses in Ext P1 were read down by this
Court; specifically the conditions of land requirement and
the minimum number of students prescribed at 300. The
Hon'ble Supreme Court affirmed the decision of this
Court, in State of Kerala Vs. M.V.B. English Medium
School 2018 (2) SCC 795 (SC).
