4. Learned counsel for the applicant has filed Rejoinder Reply,
stating therein that applicant has retired on 31.12.2008 and charge
sheet was served upon the applicant on 7.4.2010 i.e. after lapse of
about 2 years without explaining any delay, which is against the
judgment of Hon'ble Apex Court in the case of State of Madya
Pradesh V. Bani Singh 1991 SCC (L&S) 638 and P.V. Mahadevan
Vs. MDTN Housing Board reported in 2005 (SCC (L&S) 861. It is
further stated that after retirement, CMD, BSNL was competent
authority to initiate disciplinary proceedings against the applicant,
whereas in the present case I.O. and P.O. was appointed by the
DGM (Vigilance) without approval of CMD, BSNL, which is totally
illegal. It is further stated that disagreement note was issued
without indicating the reason for disagreement.
