8. Learned counsel has pointed out that the said mandatory requirement was considered by a learned Single Judge of this Court in 'Peer Mohammed v. Chirakandam Grama Panchayat' [2008 (3) KLT 300], and held that unless and until the notification is published in accordance with the requirement contained under sub-section (2) of Sec.18, there is no validity for the said provision and therefore, there is no requirement of securing NOC from the 4th respondent or the competent authority. Paragraphs 8, 13 and 14 of the said judgment are relevant to the context, which read thus:
